1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Hipopick ("we", "us", "our") and any content, features, or services offered through our website and experiences (collectively, the "Service").

By accessing or using Hipopick, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Service.

2. What Hipopick Is (and Is Not)

Hipopick is a global product discovery and recommendation platform. We help users browse curated looks, product collections, and cross-device shopping flows (for example, scanning a QR code on desktop and continuing on mobile).

Hipopick does not sell products directly. When you decide to purchase a product, you may be redirected to third-party platforms such as Hipobuy or other merchants. Any purchase you make is solely between you and the third-party platform, and is governed by that platform's own terms and policies.

Hipopick does not operate an e-commerce checkout, does not process payments, and does not provide order fulfillment or customer service for third-party purchases.

3. Eligibility and Use of the Service

You may use Hipopick only if you are legally able to enter into a binding contract in your jurisdiction, or if you have the consent of a parent or legal guardian where required by law.

You agree that you will not:

• Use the Service for any illegal, fraudulent, or unauthorized purpose
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to reverse engineer, decompile, or otherwise access non-public areas of the Service
• Use automated tools (such as bots or scrapers) in a way that overloads or harms our infrastructure

Hipopick currently does not provide user accounts, login, or registration. If we introduce accounts in the future, additional terms may apply.

4. Content and Recommendations

The content shown on Hipopick—including product cards, looks, collections, and recommendations—is for informational and discovery purposes only. We do not guarantee:

• The accuracy, completeness, or availability of any product information
• Pricing, stock status, or delivery times shown on third-party platforms
• The quality, safety, or fitness for purpose of any product

Recommendations may be influenced by factors such as popularity, quality checks, editorial curation, and advertising performance. They are not financial, legal, or professional advice.

5. Relationship with Third-Party Platforms (Including Hipobuy)

Hipopick may include links or deep links to third-party platforms such as Hipobuy or other merchants. These platforms are not controlled by Hipopick.

When you click an external link or complete a purchase on a third-party platform:

• You are subject to the third party's own terms of service and privacy policy
• The third party is solely responsible for order processing, payments, shipping, returns, and customer support
• Hipopick is not a party to the transaction and is not responsible for any issues arising from it

We may receive attribution or performance information (for example, via analytics or advertising tools) to understand whether our recommendations and cross-device flows are working, but we do not manage your purchase.

6. Analytics, Advertising, and Tracking

As described in our Privacy Policy and Cookie Policy, we use analytics and advertising measurement tools (such as Google Analytics 4 and TikTok Pixel) to understand how users interact with Hipopick and how they arrive from advertising campaigns.

We may use internal identifiers such as scan_id to connect desktop and mobile sessions, especially when you scan QR codes or use a bridge page. These identifiers are used for measurement and service improvement and are not used to personally identify you.

Your use of the Service is also subject to any applicable consent you provide via our cookie banner or browser settings.

7. Intellectual Property

Hipopick and its underlying technology, design, logos, and branding are owned by Hipopick or its licensors and are protected by copyright, trademark, and other applicable laws.

You may not:

• Use the Hipopick name, logo, or branding without our prior written consent
• Copy, reproduce, or redistribute significant portions of the Service without permission
• Create derivative works based on our design or proprietary features

Product images, trademarks, and logos belonging to third parties (including merchants and platforms like Hipobuy) are the property of their respective owners.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

In particular, we do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Any content or recommendations will be accurate, complete, or up-to-date
• Third-party platforms or products referenced on Hipopick will meet your expectations

9. Limitation of Liability

To the maximum extent permitted by law, Hipopick and its affiliates, directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with:

• Your use of or inability to use the Service
• Any actions or content of third parties, including merchants or advertising platforms
• Any transaction you make on a third-party platform (including Hipobuy)

Where our liability cannot be excluded under applicable law, it will be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Hipopick and its affiliates, directors, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your interaction with third-party platforms or merchants

11. Changes to the Service and These Terms

We may modify, suspend, or discontinue parts of the Service at any time, for example to improve performance, update features, or comply with legal requirements.

We may also update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of Hipopick after changes have been posted constitutes your acceptance of the updated Terms.

12. Governing Law and Jurisdiction

These Terms and any dispute arising out of or relating to your use of Hipopick will be governed by the laws applicable in the primary region where Hipopick operates, without regard to conflict of law principles.

Where allowed by law, you agree that any disputes will be resolved exclusively in the courts of that region.
